These terms govern your use of The Shift ("the Program"), operated by Marcus at theshift.energy. By submitting an intake form or purchasing, you agree to them. If you don't agree, please don't enrol.
The Shift is not medical care, psychotherapy, or psychological treatment. It does not diagnose, treat, cure, or prevent any disease, disorder, or condition. It is a wellness and self-improvement program delivered as personalised guided-audio recordings. Marcus is not acting as your physician, psychologist, psychiatrist, or licensed therapist.
The Program consists of eight personalised audio sessions per cycle, delivered twice weekly, built from the information you provide at intake and recorded in Marcus's voice.
If you have a diagnosed medical or mental health condition, are under psychiatric care, or take prescribed medication, use the Program alongside your provider's care and tell them you are doing so. Never stop or change prescribed treatment because of anything in these recordings.
You must be at least 18 years old. The intake form includes a safety screening, and Marcus reviews every intake personally before enrolment. Enrolment may be declined at his discretion — including where the Program is not appropriate for your circumstances. If you are declined, you are not charged.
The Program is not appropriate for anyone in crisis. If you are experiencing thoughts of self-harm or suicide, contact emergency services or a crisis line. In the US, call or text 988 (Suicide & Crisis Lifeline). Enrolment will be declined and any payment refunded.
Hypnosis has a substantial research base, and the Program is built on the memory-reconsolidation model. However, no specific outcome is promised or guaranteed. Results vary by individual, by issue, and by engagement, and depend on factors nobody can predict in advance. Any testimonial or example reflects one person's experience and is not a representation of typical results.
Sessions induce a relaxed, focused state. Never listen while driving, operating machinery, or doing anything that requires your attention. Listen somewhere safe where you can be still and undisturbed. If a session causes significant distress, stop, and contact Marcus before continuing.
Your payment method is collected at intake but not charged until Marcus has reviewed your intake and confirmed you are a fit. Payments are processed by Stripe; we never see or store your full card details.
Cancel a monthly subscription at any time through your customer portal or by replying to any email — no call, no retention process. Cancellation stops future billing; you keep every session already delivered. Prepaid packages are not cancellable mid-term but remain subject to the guarantee below.
If you listen to at least 7 of your 8 sessions in a cycle, log them using the link in each session email, and tell us at the end of that cycle that nothing has shifted, that cycle is refunded in full. Request it within 14 days of your cycle ending, by email. For prepaid packages, refunds are calculated per completed cycle.
The completion requirement exists because a protocol that wasn't run can't be evaluated, and logging is how completion is measured. Beyond this guarantee, payments are non-refundable except where required by law.
You keep ownership of everything you write in your intake. You grant permission to use it solely to create and deliver your sessions.
Your recordings are licensed to you for personal use only. You may not share, republish, resell, or distribute them. They are built from your private history and are not intended for anyone else.
Your intake is treated as confidential and used only to build your sessions. Because the Program is not licensed clinical care, legal therapist–client privilege does not apply. If you need legally privileged confidentiality, work with a licensed provider.
The Program is provided "as is." To the fullest extent permitted by law, Marcus and The Shift are not liable for indirect, incidental, or consequential damages. Total liability for any claim will not exceed the amount you paid in the three months preceding it. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit such limitation.
These terms may be updated; material changes will be emailed to active clients. Service may be suspended or terminated for misuse, non-payment, or where continuing would be inappropriate — with a pro-rata refund of any unused prepaid cycles.
These terms are governed by the laws of the State of Mississippi, United States.
